Parental Responsibility

The law on dividing of family assets during separation of co-habiting couples, divorce or dissolution of civil partnership is complex.

On divorce although the starting point is a fair division of family assets the Court has a very wide discretion in deciding who gets what. By Section 25 of the Matrimonial Causes Act 1973, the Court takes into account all the circumstances of the particular case and gives first consideration to the welfare of any minor child of the family who has not attained the age of 18.
